Guardianship of the Person
When a child is living with an adult, who is not their parent, and the adult needs a Court order to make decisions for the child, the adult will need to file for a probate guardianship.
There are two types of guardianship (you can file for one or both):

Person: To have custody of the child.

Estate: Manage the child’s property.

Filling Out Your Forms

Step 2: To complete the California Guardianship Petition, click on the following link: Guardianship Petition. Complete the form. At the end of the form, your form will be prepared for you.
You have two options for submitting the form.
- Print out the form, sign it, and file it with the Court
- Submit the form via E-filing. For e-filing instructions, click on the following link: E-Filing Instructions.
