Important!

You must call BEFORE you bring firearms or ammunition to a law enforcement agency. You have 24 hours from the time you received the restraining order or protective order to call. Follow the steps below.

  1. Call the Merced County Sheriff’s Office or the Police Department where you live. Tell them you have a restraining or criminal protective order and you need to turn in your firearm(s) and ammunition.
  2. The law enforcement agency will explain where and how to turn in your firearm(s) and ammunition. Some agencies ask you to make two trips: one for the firearm(s) and one for the ammunition. Follow their instructions carefully.
  3. Law enforcement may ask for: 
    1. a description of you and your car,
    2. your ID, and
    3. your court order.

Follow these Safety Instructions:

  • Your firearm(s) must be unloaded.
  • Place the firearm in your trunk, and lock your trunk. If you do not have a trunk, lock your firearm in a container and put it in the back of your vehicle out of arm’s reach. Do NOT put it in your glove compartment! (Calif.Penal Code§ 12026.1(a))
  • Drive straight to the law enforcement agency. Do not stop anywhere else.
  • Park your car where the agency told you to park.
  • Call the agency when you get there. They will tell you what to do. If you do not have a cell phone, leave the firearm in your car and go inside and ask for instructions.

If you want to have your firearms and ammunition destroyed:
Follow the safety instructions above. The agency will also ask you to sign a paper that gives them permission to destroy your firearm(s) and ammunition.

If your firearms are antiques or collector’s items:
When you turn in your firearm(s), tell the agency how they should be stored. Some agencies may not be able to follow your storage instructions.

You have 24 hours to turn in (or sell) your firearms and ammunition.
If the court ordered you to “relinquish” your firearms and ammunition, you have only 24 hours to do so. If you decide to sell them, you must sell them to a federally licensed gun dealer. Look in the Yellow Pages or online under “Firearms Dealers.” Be sure that the firearm dealer is federally licensed.

Questions About Safely Turning In Firearms and Ammunition

This information will answer your questions about turning in firearms. If you have other questions, call your local police department. 

What is a firearm?
Firearms include:

  • handguns and pistols,
  • rifles and shotguns,
  • black powder firearms and muzzle-loading firearms,
  • assault weapons, and
  • any weapon that sends a projectile through a barrel and the weapon’s frame or receiver.

How do I turn in my firearms and ammunition?

You have 2 options:

  • You can call your local police department or the Merced County Sheriff’s Office and ask for instructions, or
  • You can sell them to a federally licensed gun dealer. Look in the Yellow Pages or online under “Firearms Dealers.”

How long do I have to turn in my firearms and ammunition?

If the court ordered you to “relinquish” your firearms and ammunition, you only have 24 hours from the time that you received the restraining order or criminal protective order.

What if I was ordered to turn in firearms and ammunition on a weekend, can I get more than 24 hours?

No. You only have 24 hours. Law enforcement is available 24/7. 

Can I turn in my firearms and ammunition now and sell them later?

Yes. You can have one sale of the firearms and ammunition. You must use a federally licensed gun dealer for the sale. The gun dealer will give the law enforcement agency a bill of sale for the firearms and/or ammunition. If the paperwork is correct, the law enforcement agency will turn over the guns and/or ammunition to the gun dealer.

What happens if my firearms have not been registered?

It depends. Not all firearms have to be registered. But if you did not register a weapon that had to be registered, you may have committed a crime. Talk to a lawyer as soon as possible.

How long will law enforcement keep my firearms and ammunition?

Usually, they keep the firearms and ammunition until your restraining or protective order ends. If they cannot keep them for the whole period, they will let you know in writing so you can make other arrangements.

Do I have to pay law enforcement to keep my firearms and ammunition?

Maybe. Each agency has its own policy. They will tell you about any fees when you turn them in. They will also let you know in writing if their fees change.

Can a law enforcement officer take my firearms and ammunition from me?

Yes. If you are involved in domestic violence, the officer can take away your firearms and ammunition. (Calif. Family Code, § 6389(c)(2))

Can I get my firearms back from law enforcement after the court order ends?

Yes, if you are legally allowed to have a firearm. Fill out a Law Enforcement Gun Release (LEGR) Application and send it to the California Department of Justice. You can get the application at the State of California Department of Justice. You will also have to pay a fee ($20 for the first firearm and $3 for each additional firearm).

The Department of Justice will send you a notice within 4-6 weeks to tell you if you are eligible to possess a weapon again. If you are eligible, take that notice to the law enforcement agency where your firearm(s) and ammunition are stored within 30 days of the date on the notice. If you wait more than 30 days, you will have to submit another application.

  • Keep in mind that your attorney may not have much time to speak to you about your case at the court hearing, because the attorney will be busy handling many cases at that hearing.  Any further discussions with your attorney throughout the case are strongly encouraged to be done by phone.
  • In addition to speaking to the attorney about your case, it is important for you to keep the Public Defender up to date with your current address and phone number.
  • If for some reason you are not able to go to a court hearing, you must notify your attorney.  In certain cases, after speaking with you, the attorney may be able to continue your court hearing without a bench warrant being issued.  It is your responsibility to contact the Public Defender’s Office after the court hearing to find out what happened in court.

You have been sentenced for a misdemeanor offense by the Merced Superior Court.  You have been placed on unsupervised court probation and ordered to do one or more of the following:

  • Pay a fine—All fines ordered by the Court are to be paid through the Merced Superior Court Collections.  Merced Superior Court Collections has four locations: 2260 N St., Merced, CA 95340; 627 W 21st St., Merced, CA 95340; 720 W 20th St., Merced, CA 95340; and 1159 G St., Los Banos, CA 93635. Phone #: (209) 725-4220.  You must go to pay your fine or make arrangements to make monthly payments.
  • Serve a jail sentence—Jail sentences are to be served through the Merced County Sheriff’s Office.  The Court may have given you a future date to start your jail sentence.  You should use this time to go to the Merced County Probation Department located at 600 Olive Ave.  You can discuss with the staff different ways to fulfill your jail sentence, including electronic monitoring and work in lieu of confinement.  You will need to fill out an application for each program and meet certain requirements to qualify.  Go to the Merced County Probation Department immediately after you are sentenced to receive information and fill out an application to qualify for a program.  You must do so right away because it takes several weeks for the Sheriff’s Office to process your application, and it must be approved before your date to report arrives.
  • Attend and complete a court-ordered program—You may have been ordered to sign up for and attend a counseling or education program as part of your sentence.  Examples include court-ordered programs for driving under the influence and programs for domestic violence counseling.  You should contact the program and sign up as soon as possible.  In certain cases, you have been ordered back to court to show proof that you have enrolled in or completed the program. Information About Fines and Programs will be provided for you today or can be obtained from the Criminal Clerk’s Office or on our website under Local Forms: www.mercedcourt.org.
  • Complete community service—You may have been ordered to complete community service.  You must contact the Probation Department, located at 600 Olive Avenue, Merced, CA 95348, to choose a community service assignment.  The telephone # is (209) 381-1380.  If ordered to complete community service, you will be ordered back to court to show written proof that you have completed the community service assignment. 

You must complete every part of your sentence.  Failure to complete any part of the court-ordered sentence may result in a violation of probation, an order to return back to court, or a warrant being issued for your arrest.  If you have questions, please speak to your attorney or court staff, who can answer your questions.

Instrucciones de la Imposición de Condena

The Following Is Made a Part of The Court’s Order:

  1. Unless otherwise ordered by the Court, these Standard Orders apply to all cases. If there is an active Domestic Violence Restraining Order or Criminal Protective Order associated with this case, then the following provisions do not apply: Paragraphs 13, 14, 15, 19, and 20.
  2. Notifications: Required notifications shall be by a verifiable method, such as text message, email, or parenting app, with the parent providing notification, maintaining a copy in his/her records. Parents are responsible for keeping a log of notifications. Parents to produce such proof of notification to the Court if required by the Court.
  3. Disparaging or negative remarks about the other party. Parents shall not make negative or disparaging remarks about the other parent or persons residing in the other parent’s home in the presence of the child(ren) or allow the child(ren) to be present while negative remarks are being made by third parties about either parent or persons residing in the other parent’s home. If third parties make such comments and refuse to stop such behavior upon request, the parent is responsible for intervening and removing the child(ren) from exposure to this behavior.
  4. No discussion of this case with the child. Parents are ordered not to discuss this Court case with the child(ren) or in the child(ren)’s presence other than to tell the child(ren) how he/she will see each parent.
  5. Use of illegal substances: Parents shall not use illegal substances, no exceptions. Parents are responsible to ensure that the person(s) they leave their child(ren) with shall not use illegal substances. Parents shall not leave their children with, allow to reside in their home, or otherwise permit the children to come into contact with persons known to use illegal substances. Parents shall not have illegal substances in his/her possession, vehicle, or residence.
  6. Use of prescription medications: Parents shall solely use prescription medications that have the possibility of abuse (ex. opiates; benzodiazepines) as lawfully authorized by a qualified medical prescriber and in accordance with the prescription orders. Parents shall not leave their child(ren) with, allow to reside in their home, or otherwise permit the child(ren) to come into contact with persons who are abusing or misusing prescription medications that have the potential for abuse/addiction. Even if the medication is prescribed, if compelling evidence of misuse or abuse is provided to the Court, parents are advised this may be considered by the Court in making decisions regarding custody.
  7. Use of marijuana: Parents shall use marijuana responsibly and in accordance with California Law. Parents shall ensure that marijuana and the paraphernalia associated with such use is properly stored and not accessible to the child(ren). Parents shall not use marijuana in the presence of their children nor permit the children to be in the presence of any third party who is using marijuana.
  8. Use of alcohol: Parents or persons a parent allows contact with the child(ren) shall use alcohol responsibly and in accordance with California Law. Parents shall ensure that alcohol is properly stored and not accessible to the child(ren).
  9. Transportation for Visitation. The children must be driven only by a licensed and insured driver. The vehicles must be legally registered with the Department of Motor Vehicles and must have child restraint devices properly installed, as required by law.
  10. Tracking Device. Parents shall not attach/enable or access a mobile tracking device on the child(ren)’s person or property during the other parent’s custodial time, unless a written order is issued by the Court. Nothing in this order shall prevent a parent from using a tracking device during their custody time with the child(ren). A tracking device is an electronic or mechanical device that permits the tracking of the movement of a person or object.
  11. Social media: Parents shall use social media and the internet responsibly. Parents are advised that misuse of social media and the internet may be considered by the Court in making custody orders.
  12. Child’s contact with the parent. Unless otherwise specified, each parent shall exert every effort to maintain unhampered contact between the child(ren) and the other parent. Neither parent shall do anything which would estrange the child(ren) from the other parent or impair the natural development of the child(ren)’s love and respect for each parent.
  13. Parent’s contact with the child. Each parent is entitled to reasonable telephone/video communications with the child(ren). The communication must be appropriate in number each day, reasonable in length, at appropriate times, and according to what is best for the child(ren)’s schedule. The parents may not use such information for the purpose of harassing, annoying, or disturbing the peace of the other or invading the other’s privacy. This provision shall not apply when the Court has made specific orders regarding telephone/video communication with the child(ren).
  14. Change of address or telephone number. Each parent shall provide the other parent with the address and telephone number where the child(ren) lives. Each parent shall notify the other with at least a 45- days advance written notice of any such change. All notices shall be sent by verifiable means.
  15. Temporary absences. If the parent and child(ren) will be away from the normal place of contact for over-night the parent having the child(ren) shall provide the other parent with the telephone number or location where the child(ren) can be reached or located.
  16. Child(ren)’s right to privacy. Unless the Court specifically Orders otherwise, each parent is restrained from interfering with the child(ren)’s right to privacy during telephone conversations with the other parent.
  17. Child(ren)’s rights to their own possessions. The child(ren) shall remain the owner of his/her/their belongings, and such items shall transfer with the child(ren) when possible and appropriate.
  18. Emergency medical treatment. Either parent may obtain emergency health care for the child(ren) without the other parent’s consent. Each parent must notify the other parent as soon as reasonably possible and safe to do so of any illness/injury requiring medical attention or emergency treatment involving the child(ren).
  19. Child(ren)’s schedule and extra-curricular activities. Unless otherwise specified by the court, each parent shall be responsible for keeping him/herself advised of school, athletic, and extra-curricular events of the child(ren), including the schedule of these events. Unless specifically ordered otherwise, both parents may fully participate in all activities that the child(ren) is involved in and should work together to ensure that the child(ren) attend and maintain involvement in the activity during all periods of care, custody, and control.
  20. No use of the child(ren) as messengers. The parents SHALL NOT use the child(ren) as messengers between them.
  21. Modification and Changes to the Order. The existing order shall remain in effect until modified by the Court. One parent or both may file to return to the Court if they wish to modify their current order. The parties have the ability to mutually agree to change any terms or conditions of this Order. If the parties wish for any agreed changes to be enforceable, they must submit to the Court a Stipulation and Order form for the Court’s approval and signature. For any informal agreements to change the terms or conditions, such changes should be placed in writing, signed, and dated by both parties, with each party retaining a copy of the agreement. Parents may use email or parenting apps to make such agreements with each parenting sending a confirmation message when an agreement has been reached.
  22. Questions concerning this Order. If you have a problem understanding this custody and visitation order, contact the Self-Help Center. 23. Problems with the other parent. If you have a problem with enforcement of this order, contact the local Police Department or Sheriff’s Department. Law enforcement personnel are mandated to assist.
  23. Violation of this order is a crime. Failure to obey this order shall be deemed a violation of Sections 166.4 (Contempt of Court), 273.6 (Violation of a Court Order), and 278.5 (Violation of Custody or Visitation Decree) of the California Penal Code. Dissatisfaction with the other parent or a child not wanting to go cannot be used as a reason for keeping the child or oneself from complying with the order.

For Optional Use

(TO ORDER RE: CHILD SUPPORT)

THE FOLLOWING IS MADE A PART OF THE COURT’S ORDER:

  1. Merced County Department of Child Support Services (DCSS) shall open a case on behalf of the custodial party, and parties shall cooperate with DCSS in compliance with this order.
  2. All payments shall be made to:

  3. Child support payments are payable by Order/Notice to Withhold Income for Child Support (form FL-195). An Order/Notice to Withhold Income for Child Support (form FL-195) will issue.
  4. The non-custodial parent/Obligor must (a) provide and maintain health insurance coverage for the children as obligated by law, and (b) within twenty (20) days of the DCSS request, complete and return a Health Insurance Form. Each party is responsible for one-half (1/2) of all medically necessary uninsured medical costs. A Health Insurance Coverage Assignment (form FL-470) will issue.
  5. No provision of this judgment/order may operate to limit any right to collect the principle (total amount of unpaid support) or to charge and collect interest and penalties as allowed by law. Interest will accrue on the entire principal balance owing and not on each installment as it becomes due. All payments ordered are subject to modification.
  6. All parties must notify DCSS within ten (10) days in writing of any change in residence, income, or employment.
  7. The non-custodial parent/Obligor is responsible for paying all child support and reimbursement payment obligations as of the effective date of the order and shall be responsible for making voluntary payments during any period of time when payments are not being made by an Order/Notice to Withhold Income for Child Support.
  8. In the event that the provisions in California Family Code §4007.5 sunset or are not applicable, Child Support Suspending Events pursuant to this order include, but are not limited to:
    1. The obligation of the person ordered to pay support shall be suspended for any period exceeding ninety (90) consecutive days in which the person ordered to pay support is incarcerated or involuntarily institutionalized, or has received a grant of SSI/SSP or public assistance benefits (hereinafter "suspending event"), unless the Obligor has the means to pay support during the suspending event.
    2. The suspension of the support obligation shall only apply for the period during the suspending event. The support obligation shall resume in the amount specified in the child support order as follows:
      1. events involving a grant of SSI/SSP or public assistance: the first day of the first (1st) full month following termination of the suspending event.
      2. for all other suspending events: the first day of the tenth (10th) full month following termination of the suspending event.
    3. The court reserves jurisdiction to set the arrears balance on a case where retroactive benefits were received and/or a lump sum benefit was received from the Federal government.
    4. For purposes of this section, "incarcerated or involuntarily institutionalized" includes, but is not limited to, involuntary confinement to a state prison, county jail, juvenile facility operated by the Division of Juvenile Facilities in the Department of Corrections and Rehabilitation, a mental health facility, or a court- ordered live-in drug or alcohol treatment program that lasts for at least ninety (90) consecutive days and which prevents Obligor from earning income other than that which is paid to the program as a term of that program.

      This provision shall also apply to the voluntary enrollment by the Obligor into a live-in drug or alcohol treatment program that lasts for at least ninety (90) consecutive days and which prevents Obligor from earning income other than that which is paid to the program as a term of that program.

    5. The obligation to pay current child support by an Obligor shall be suspended upon the Obligor's reunification with the family for a period exceeding thirty (30) consecutive days, and shall automatically reinstate upon the separation of the Obligor from the family commencing the first day of the first month following separation.
    6. For purposes of this section, "suspend" means that the payment due on the current child support order, an arrears payment on a preexisting arrears balance, or interest on arrears created during a suspending event pursuant to this section is, by operation of law, set at zero dollars ($0) for the period as defined above.
  9. In any case, where the court has ordered as part of the child support order an add-on for child care, the custodial parent shall notify the non-custodial parent and DCSS in writing within ten (10) days of any change in the child care expense. The court reserves jurisdiction to retroactively modify support for a period of sixty (60) days after such notification is provided. In the event such notification was not provided to the noncustodial parent and DCSS, the court reserves jurisdiction to retroactively modify the order to reflect the child care change.
  10. In any order based in whole or in part upon the stipulation of an Obligee to a waiver of any past due child support and/or interest owed to said Obligee, the court, unless expressly stated to the contrary in said stipulation and order, reserves jurisdiction to vacate, set aside, or otherwise retroactively modify said waiver in whole or in part, and reinstate the arrears waived, based upon a showing of good cause by any party to the action.
    1. There shall be a rebuttable presumption of good cause where the court finds that the Obligor has willfully failed to comply with any order of the court within the action, including the obligation to pay current or past due support, or in any other case where the basis for the stipulation on the part of the Obligee was stated in the stipulation and thereafter willfully violated by the Obligor.
  11. Unless specifically ordered by the court on the record to the contrary, whenever the parties have stipulated to a waiver by either party or both parties of the Standard Order requiring employer-base health care insurance for the minor child(ren), in whole or in part based upon alternative health insurance being provided, then the obligation to provide employer-based health insurance shall automatically reinstate forthwith upon the termination of the alternative coverage.
  12. When an arrears balance accrues after current child support has been ordered or when an arrears payment amount was not established, a payment will be automatically established based on the interest accruing each month. The payment shall be in increments of $25.00 based on the interest owing (i.e. if interest is owing in the amount of $33.00 each month, then the payment would be $50.00 per month; if interest is owing in the amount of $116.00 per month, then the payment would be $125.00 per month, etc.)

NOTICE:  Any party required to pay child support must pay interest on overdue amounts at the "legal" rate, which is currently 10 percent.

Juvenile Case File Disclosure
Welfare & Institutions Code (WIC) § 827

Statutory Scheme:

Juvenile Court records are confidential to protect the privacy rights of the child. WIC § 827 and California Rules of Court (CRC) 5.552 control the inspection and dissemination of a "juvenile case file." Juvenile case files are not discoverable by subpoena. Certain persons or entities are authorized by law to inspect the records without petition. §827, sub. (a)(1). Such persons or entities must inspect the records before submitting a petition. All other persons or entities must petition the Juvenile Court to inspect the records. All persons must seek Juvenile Court authorization to disseminate the records or information (this includes DAs and other persons permitted to inspect records without petition). § 827, subd. (a)(4).

Additionally, the juvenile case file may contain material that is privileged pursuant to state or federal law, which prevails. § 827, subd. (a)(3)(A). These include:

  • Privileges under Evidence Code, Division 8 (§900 et seq.)
  • Health Insurance Portability and Accountability Act (HIPAA)
  • Penal Code §11167 (confidentiality of child abuse reporter)

The “juvenile case file" - § 827(e):

The "juvenile case file" are dependency or delinquency records maintained by the court, probation, social services agency, and law enforcement; they may contain personal information – psychological assessments, education records, medical records, drug test results, and California Information and Identification (Cll) information for the minor, the parents or extended family. WIC § 827 controls disclosure even if a case was not filed. The juvenile case file may include:

  • Court Delinquency (WIC § 601, et seq.) or Dependency (WIC § 300, et seq.) files
  • Probation Department files - containing: risk/needs assessments, case management notes, and drug test results
  • Social Services Agency files - containing: SSA reports, medical records, case management notes, school records, parent & relative information, psychotropic medication information, psychological assessment and treatment information, visitation logs, police reports, CASA reports, witness statements

The § 827 Petition:

A petition seeking disclosure of the juvenile case file must describe in detail - CRC 5.552(b):

  • The specific records sought
  • The reasons and relevance to the purpose they are sought

Judicial Ruling on an § 827 Petition for records:

Relevance - CRC 5.552(d)(6): disclosure, only if petitioner shows by a preponderance of the evidence the records "are necessary and have substantial relevance to the legitimate needs of the petitioner" (including credibility of the minor and other witnesses).

Balancing test - CRC 5.552(d)(4): disclosure also requires the Court balance:

  • The interests of the child and other parties to the juvenile court proceeding
  • The interests of the petitioner seeking discovery
  • The interests of the public

Hearing & In-Camera Review:

Hearing - CRC 5.552(d)(2): "If petitioner shows good cause, the court may set a hearing." In-Camera Review -CRC 5.552(d)(3): "Whether or not the court conducts a hearing, [if there are records the petitioner may be entitled to],the court must conduct an in-camera review of the juvenile case file and any objections and assume that all legal claims of privilege are asserted."

Redaction and Protective Orders:

Redaction - the court may order information redacted from records to be disclosed, including:

  • Social security numbers
  • Driver's license numbers
  • Identity of other minors revealed in the records
  • Other identity or contact information
  • Irrelevant information

Protective Orders -CRC 5.552 (d)(8): court may issue order controlling disclosure, dissemination, access, and copying.

Procedural Path:

WIC § 827 petitions will follow an established procedural path:

  1. Any pre-filing inspections by counsel should be made at: a. Juvenile Delinquency (WIC § 601, et seq.) case files: 2840 W. Sandy Mush Road, Merced, CA 95341. b. Juvenile Dependency (WIC § 300, et seq.) case files: 627 W. 21st Street, Merced, CA 95340.
  2. Juvenile Court staff will obtain the court’s juvenile case file, and when appropriate, the Social Services Agency or Probation case file. The Social Services Agency or Probation will be required to provide un-redacted and proposed redacted copies of its file.
  3. Juvenile Court staff will review the petition for sufficiency and service of notice - CRC 5.552(c).
  4. If the petitioning party does not know the identity or address of a necessary party, Juvenile Court staff will provide the proper notice- CRC 5.552(c)(3).
  5. Once proper notice is provided, Juvenile Court staff will provide the file to the Judicial Officer to determine whether the assistance of the Court Staff Attorney is needed.
  6. The Judicial Officer or the Court Staff Attorney will review the petition to determine whether petitioner provided sufficient detail to engage in the balancing test. The petition must be denied and returned if insufficient detail is provided.
  7. If sufficient detail is provided, the Judicial Officer or the Court Staff Attorney will perform an initial review of the file and identify: a. Records clearly relevant that should be produced. b. Records clearly irrelevant and should not be produced.
  8. The Court Staff Attorney will prepare his/her decision recommendations for the appropriate Judicial Officer to review.
  9. The Court Staff Attorney will send the file, the petition, any objections, decision recommendations, and blank JV forms for granting or denying the petition to the appropriate Judicial Officer.
  10. The Judicial Officer will conduct a review of the case file, per § 827 & CRC 5.552.
  11. The Judicial Officer will issue a ruling, by completing and signing or directing the completion of Judicial Council form JV-574 (or form JV-573 for a total denial of the petition).
  12. Staff for the assigned Judicial Officer will return the signed and completed JV-574 or JV-573 form, the juvenile case file, the petition, and objections to Juvenile Court staff.
  13. Juvenile Court staff will provide all interested parties with notice of the Court's ruling, and when necessary, with a court date for a hearing.
  14. When a petition is granted, redactions will be made as directed by the Judicial Officer pursuant to WIC § 827(a)(3)(A) before release.
  15. When a petition is granted, the Judicial Officer will provide instructions as to where and how the petitioner may obtain copies of the records ordered disclosed from the custodian of the records.

Exigent circumstance: In the event of a time critical need for compliance with WIC § 827 on an expedited basis, the trial judge or Supervising Judge may phone or email the Juvenile Court Presiding Judge for special handling. (CRC 5.552(c)(1), requires ten days’ notice, which may be shortened for good cause - subd. (c)(4).)

Judicial Council Form JV-574:

The Court's ruling on a § 827 petition will be made on Judicial Council form JV-574 (or form JV-573 for a total denial of the petition), including identification of the records to disclose, redaction orders, and protective orders. Guidelines for completion of JV-574:

  • Section 3-a: identify the records to be released.
  • Section 3-b: information for obtaining copies from the Custodian of Records will be provided by Juvenile Court staff.
  • Section 4 & 5: are generally not applicable for cases filed in other case types.
  • Section 6: check box to bar unauthorized dissemination.
  • Section 7: protective orders - (limitation only to specific litigation, no unauthorized viewing, copying or dissemination, return/destruction upon conclusion of litigation, etc.).
  • Section 8: check box if partial production of the records is ordered.
  • Section 9: check box if redaction orders are made.  Section 10: make any orders requiring the custodian of the records to redact certain identified information. [The reviewing Court may wish to identify information to be redacted by making a copy of the document and highlighting the section(s).
